These Terms of Service ("Terms") govern your use of WellMate ("the App", "we", "us", "our"), available as a web, Android, and iOS application. By creating an account or using the App, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and the Health Disclaimer below. If you do not agree, do not use the App.
WellMate is not a medical application and does not provide medical advice. All content — including calorie and macro calculations, diet plans, targets, health tracking, safety checks, and AI features — is provided for general informational and educational purposes only.
The App does not diagnose, treat, cure, or prevent any disease or health condition, is not a medical device, and has not been clinically validated. Using the App does not create a doctor–patient or dietitian–client relationship.
Information and targets are recommendations, not instructions, and are not guaranteed to be accurate, complete, or suitable for you.
Always consult a qualified physician or registered dietitian/nutritionist before starting, changing, or stopping any diet, fasting, exercise, or health routine. This is especially important if you:
Stop using the App and seek medical attention if you experience any adverse effects. The App is not for medical emergencies — if you have a medical emergency, call your local emergency number immediately.
Calorie, macronutrient, and other nutritional values shown in the App are estimates and approximations, derived from formulas (e.g. BMR/TDEE), public food data, and user input. They may be inaccurate or incomplete. Individual nutritional needs vary. Calorie goals and diet recommendations are general guidance only. Nutrition data may not reflect allergens or ingredients — always verify before consuming any food. You are responsible for verifying any information before relying on it.
The App offers optional AI features, including food recognition from photos and AI-generated diet analysis. You acknowledge that:
We make no guarantee of any specific result, including weight loss, weight gain, or any health or fitness outcome. Outcomes depend on many factors outside our control.
You agree not to: use the App unlawfully; access others' accounts or data; reverse engineer, decompile, or disassemble the App; disrupt its infrastructure; or use automated scripts or abuse AI features.
You understand and agree that any use of dietary, fasting, or health information from the App is entirely at your own risk, and that you assume full responsibility for any decisions or actions you take based on it.
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that data or results will be accurate or reliable.
To the maximum extent permitted by law, WellMate and its owners, team, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any health outcomes, injury, loss, or data loss, arising from or related to your use of (or inability to use) the App, AI features, or any information provided. Where liability cannot be excluded, our total liability is limited to the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless WellMate and its team from any claims, damages, liabilities, and expenses arising from your use of the App, your violation of these Terms, or your reliance on any information or AI output.
All content, designs, logos, and code in WellMate are our property and protected by applicable laws. You may not copy, modify, or distribute any part of the App without written permission.
The App relies on third-party services including Google Firebase (hosting, authentication, database), AI providers (for AI features), and Razorpay (payments). Your use may also be subject to their terms. We are not responsible for third-party services.
Your use is governed by our Privacy Policy. By using the App you consent to the collection and use of information as described there, including sensitive health-related data you choose to provide.
We may suspend or terminate your account for violations of these Terms. You may delete your account anytime from Profile → Delete My Account.
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date, and continued use after changes constitutes acceptance. We may ask you to re-accept updated Terms.
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to applicable law, the courts located in India shall have jurisdiction over any disputes. Nothing in these Terms limits any consumer rights you may have under the laws of your country of residence.
